Welcome to Home Maintenances (“Platform”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the website homemaintenances.in and all related services.
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
Important: Home Maintenances is an online marketplace that connects customers with independent service providers, shopkeepers and scrap buyers. We are not the service provider ourselves.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Home Maintenances under the Indian Contract Act, 1872. Continued use of the Platform after any update constitutes your acceptance of the revised Terms.
2. Description of Service
Home Maintenances is a digital marketplace that enables users to:
- Find and contact verified local service providers (electricians, plumbers, painters, carpenters, etc.)
- Purchase products from local shopkeepers
- Connect with scrap buyers for e-waste, metal, paper and other recyclable materials
We act solely as an intermediary and do not employ or control the service providers, shopkeepers or scrap buyers listed on the Platform.
3. Eligibility
- You must be at least 18 years of age to use the Platform.
- You must have the legal capacity to enter into a binding contract under Indian law.
- If you are registering on behalf of a business, you confirm that you are authorised to do so.
4. User Accounts
- You agree to provide accurate, complete and up-to-date information during registration.
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. User Responsibilities
You agree that you will not:
- Use the Platform for any unlawful, fraudulent or harmful purpose
- Post false, misleading, defamatory or offensive content
- Impersonate any person or entity
- Interfere with the proper working of the Platform
- Attempt to gain unauthorised access to any part of the Platform
- Use automated systems (bots, scrapers) without our prior written consent
6. Role of Home Maintenances (Marketplace Disclaimer)
Home Maintenances is an intermediary under the Information Technology Act, 2000. We do not:
- Provide any home maintenance or repair services ourselves
- Guarantee the quality, safety, legality or timing of services offered by third-party providers
- Endorse or recommend any particular service provider
- Participate in the actual service delivery or payment settlement between users and providers (unless otherwise stated)
All contracts for services or products are formed directly between the customer and the respective vendor.
7. Payments, Fees & Refunds
- Payments for services or products are generally made directly between the customer and the vendor.
- Any platform fees or convenience charges charged by us (if applicable) will be clearly disclosed before payment.
- Refunds, cancellations and disputes regarding services or products are subject to the individual vendor’s policy and applicable consumer laws.
- We are not responsible for payment disputes arising between users and third-party vendors.
8. Intellectual Property
All content, logos, trademarks, software, design and branding on the Platform are the exclusive property of Home Maintenances or its licensors. You may not copy, modify, distribute or create derivative works without our prior written permission.
9. Limitation of Liability
To the maximum extent permitted under Indian law:
- Home Maintenances shall not be liable for any indirect, incidental, special, consequential or punitive damages.
- Our total aggregate liability arising out of or related to these Terms or your use of the Platform shall not exceed the total fees (if any) paid by you to us in the twelve (12) months preceding the claim.
- We are not liable for any loss, damage, injury or dispute arising from services rendered by third-party vendors listed on the Platform.
10. Indemnification
You agree to indemnify, defend and hold harmless Home Maintenances, its directors, employees and agents from any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.
11. Termination
We may suspend or permanently terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Subject to the Consumer Protection Act, 2019, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
Users are encouraged to first contact our support team to resolve any issue amicably.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
